Deze voorwaarden gelden voor het gebruik van Hedwig. Lees ze rustig door. Bij verschil tussen de Nederlandse en de Engelse tekst gaat de Nederlandse tekst voor.

1. Toepasselijkheid

Deze licentievoorwaarden gelden voor het gebruik van de app Hedwig („Hedwig”), aangeboden door de uitgever die onder Contact staat („wij”). Door Hedwig te installeren of te gebruiken aanvaardt u deze voorwaarden. Wie Hedwig via de App Store van Apple verkrijgt, sluit deze overeenkomst met ons en niet met Apple. Wij zijn als enige verantwoordelijk voor Hedwig en de inhoud ervan.

2. Gebruiksrecht

Wij geven u een niet-exclusief, niet-overdraagbaar en herroepbaar recht om Hedwig te gebruiken op Apple-apparaten die u bezit of beheert, binnen de Gebruiksregels van de App Store, behalve voor zover Delen met gezin of volume-aankoop van Apple dat toestaat. U mag Hedwig gebruiken voor uzelf, uw familie en de mensen voor wie u zorgt, ook binnen een zorginstelling. U koopt Hedwig eenmalig in de App Store van Apple tegen de daar vermelde prijs; de betaling en een eventuele terugbetaling lopen via Apple. Daarna zijn er geen kosten voor Hedwig zelf; luisteren via internet rekent Speechmatics rechtstreeks met u af.

3. Wat niet mag

U mag Hedwig niet verhuren, verkopen, in sublicentie geven of op een andere manier aan derden ter beschikking stellen, en de beveiliging of de licentie niet omzeilen. U mag Hedwig niet decompileren, ontleden of wijzigen, behalve voor zover de wet dat uitdrukkelijk toestaat.

4. Rechten van intellectuele eigendom

Het auteursrecht op Hedwig, het ontwerp en de teksten berust bij Kai Guldemond, de maker (© 2026). Wij bieden Hedwig aan onder licentie van de maker. Hedwig bevat onderdelen van derden met een eigen licentie, zoals FluidAudio (Apache 2.0), Parakeet Ultra (CC BY 4.0), pyannote Community-1 en Silero VAD (MIT). Die staan bij Over Hedwig en privacy. Voor die onderdelen gaan hun eigen licenties voor.

5. Geen medisch hulpmiddel

Hedwig is een hulpmiddel bij gesprekken. Het is geen medisch hulpmiddel en geen vervanging van een hoortoestel of tolk. De tekst wordt automatisch gemaakt en kan fouten bevatten, ook in namen. Neem belangrijke beslissingen, bijvoorbeeld over gezondheid, medicijnen, geld of juridische zaken, niet op grond van de tekst alleen. Gebruik Hedwig niet als enige middel in noodsituaties.

6. Diensten van derden

Voor luisteren via internet gebruikt Hedwig Speechmatics, met uw eigen account en sleutel. U houdt zich aan de voorwaarden van Speechmatics, Hugging Face en uw internetaanbieder; u betaalt Speechmatics rechtstreeks. Wij zijn daarbij geen partij en zijn niet verantwoordelijk voor de beschikbaarheid, de kwaliteit of de kosten van die dienst. Hedwig helpt onbedoelde kosten te beperken (pauze bij stilte, een vraag om door te gaan, een maandbedrag als grens, waarschuwingen bij een laag tegoed), maar dat zijn hulpmiddelen op basis van schattingen; wat Speechmatics u in rekening brengt is bepalend, ook als een schatting afwijkt of een beveiliging niet werkt zoals verwacht. U bent zelf verantwoordelijk voor uw account en uw kosten bij Speechmatics. De spraakmodellen voor de iPad komen van Hugging Face en vallen onder hun eigen licenties.

7. Toestemming en privacy

U bent zelf verantwoordelijk voor het gebruik van Hedwig in uw omgeving. Neem een foto of stem van iemand alleen op als die persoon daarmee instemt, en laat de mensen in het gesprek weten dat Hedwig meeluistert. Hoe Hedwig met gegevens omgaat, staat in het privacybeleid en bij Over Hedwig en privacy.

8. Onderhoud en ondersteuning

Wij bieden Hedwig aan zoals het is. Wij doen ons best om fouten te herstellen en vragen te beantwoorden via het adres onder Contact, maar zijn niet verplicht tot updates of ondersteuning, behalve voor zover de wet dat vereist. Apple heeft geen enkele verplichting om onderhoud of ondersteuning voor Hedwig te leveren.

9. Garantie

Voor zover de wet dat toestaat, geven wij geen garanties over Hedwig, ook niet dat het foutloos of zonder onderbreking werkt. Uw wettelijke rechten als consument, zoals het recht op digitale inhoud die aan de overeenkomst beantwoordt, blijven onverminderd gelden. Voldoet Hedwig niet aan een toepasselijke garantie, dan kunt u Apple daarvan op de hoogte stellen; Apple betaalt dan de eventuele aankoopprijs terug en heeft verder geen garantieverplichting.

10. Aansprakelijkheid

Voor zover de wet dat toestaat, zijn wij niet aansprakelijk voor indirecte schade of gevolgschade, en is onze aansprakelijkheid beperkt tot het bedrag dat u voor Hedwig hebt betaald. Deze beperkingen gelden niet bij opzet of bewuste roekeloosheid, en niet voor zover dwingend recht, zoals het consumentenrecht, ze niet toestaat.

11. Aanspraken over Hedwig

Wij, en niet Apple, zijn verantwoordelijk voor aanspraken van u of derden over Hedwig, zoals aanspraken uit productaansprakelijkheid, wegens het niet voldoen aan wettelijke eisen of privacyregels, of op grond van consumentenbescherming. Stelt een derde dat Hedwig inbreuk maakt op zijn intellectuele eigendom, dan zijn wij, en niet Apple, verantwoordelijk voor het onderzoek, de verdediging, de schikking en de afhandeling daarvan.

12. Exportregels

U verklaart dat u zich niet bevindt in een land waarvoor een embargo van de Europese Unie of de Verenigde Staten geldt of dat door de Amerikaanse overheid als „terrorist supporting” is aangemerkt, en dat u niet voorkomt op een sanctielijst van de Europese Unie of de Verenigde Staten.

13. Apple als derde

Apple en haar dochterondernemingen zijn derde-begunstigden van deze voorwaarden. Zodra u deze voorwaarden aanvaardt, heeft Apple het recht om ze als derde-begunstigde tegenover u af te dwingen.

14. Einde

U kunt deze overeenkomst op elk moment beëindigen door Hedwig te verwijderen. Het gebruiksrecht eindigt vanzelf als u deze voorwaarden niet naleeft. Na het einde verwijdert u Hedwig van uw apparaten.

15. Wijzigingen

Wij kunnen deze voorwaarden aanpassen. De geldende versie staat altijd in Hedwig. Belangrijke wijzigingen melden wij op tijd in de app. Gebruikt u Hedwig daarna, dan gelden de nieuwe voorwaarden; gaat u er niet mee akkoord, dan kunt u Hedwig verwijderen.

16. Toepasselijk recht en geschillen

Op deze voorwaarden is Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter in Amsterdam. Bent u consument, dan behoudt u de bescherming van de dwingende regels van het land waar u woont en kunt u ook naar de rechter van uw woonplaats stappen.

These terms apply to the use of Hedwig. Please read them carefully. If the Dutch and English texts differ, the Dutch text prevails.

1. Scope

These licence terms apply to the use of the Hedwig app (“Hedwig”), offered by the publisher listed under Contact (“we”). By installing or using Hedwig you accept these terms. If you obtain Hedwig through Apple’s App Store, you enter into this agreement with us and not with Apple. We alone are responsible for Hedwig and its content.

2. Licence

We grant you a non-exclusive, non-transferable and revocable right to use Hedwig on Apple devices that you own or control, as permitted by the App Store Usage Rules, except to the extent Apple’s Family Sharing or volume purchasing allows otherwise. You may use Hedwig for yourself, your family and the people you care for, also within a care institution. You buy Hedwig once in Apple’s App Store at the price shown there; payment and any refund go through Apple. After that there are no charges for Hedwig itself; listening via the internet is billed to you directly by Speechmatics.

3. Restrictions

You may not rent, sell, sublicense or otherwise make Hedwig available to third parties, or circumvent its protection or licence. You may not decompile, reverse engineer or modify Hedwig, except where the law expressly permits it.

4. Intellectual property

The copyright in Hedwig, its design and its texts belongs to Kai Guldemond, its maker (© 2026). We offer Hedwig under licence from the maker. Hedwig contains third-party components with their own licences, such as FluidAudio (Apache 2.0), Parakeet Ultra (CC BY 4.0), pyannote Community-1 and Silero VAD (MIT). They are listed under About Hedwig and privacy. For those components their own licences prevail.

5. Not a medical device

Hedwig is a conversation aid. It is not a medical device and not a replacement for a hearing aid or interpreter. The text is produced automatically and may contain errors, including in names. Do not make important decisions, for example about health, medication, money or legal matters, on the basis of the text alone. Do not rely on Hedwig as the only means in emergencies.

6. Third-party services

For listening via the internet Hedwig uses Speechmatics, with your own account and key. You comply with the terms of Speechmatics, Hugging Face and your internet provider; you pay Speechmatics directly. We are not a party to it and are not responsible for the availability, quality or cost of that service. Hedwig helps to limit unintended costs (pausing when it is quiet, asking to go on, a monthly amount as a limit, warnings when the credit is low), but these are aids based on estimates; what Speechmatics charges you is decisive, even if an estimate is off or a safeguard does not work as expected. You are responsible for your own account and costs at Speechmatics. The speech models for the iPad come from Hugging Face and are subject to their own licences.

7. Consent and privacy

You are responsible for how Hedwig is used around you. Only record someone’s photo or voice if that person agrees, and let the people in the conversation know that Hedwig is listening. How Hedwig handles data is described in the privacy policy and under About Hedwig and privacy.

8. Maintenance and support

We provide Hedwig as it is. We do our best to fix errors and answer questions via the address under Contact, but we are not obliged to provide updates or support, except where the law requires it. Apple has no obligation whatsoever to provide maintenance or support for Hedwig.

9. Warranty

To the extent permitted by law, we give no warranties about Hedwig, including that it works without errors or interruption. Your statutory rights as a consumer, such as the right to digital content that conforms to the agreement, remain unaffected. If Hedwig fails to conform to any applicable warranty, you may notify Apple; Apple will then refund any purchase price and has no other warranty obligation.

10. Liability

To the extent permitted by law, we are not liable for indirect or consequential damage, and our liability is limited to the amount you paid for Hedwig. These limitations do not apply in case of intent or deliberate recklessness, nor to the extent mandatory law, such as consumer law, does not permit them.

11. Claims about Hedwig

We, and not Apple, are responsible for addressing claims by you or third parties relating to Hedwig, such as product liability claims, claims that Hedwig fails to meet legal requirements or privacy rules, and claims under consumer protection law. If a third party claims that Hedwig infringes its intellectual property, we, and not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.

12. Export rules

You represent that you are not located in a country subject to a European Union or United States embargo or designated by the United States government as “terrorist supporting”, and that you are not listed on a European Union or United States sanctions list.

13. Apple as a third party

Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple has the right to enforce them against you as a third-party beneficiary.

14. Termination

You can end this agreement at any time by deleting Hedwig. The licence ends automatically if you do not comply with these terms. After it ends, you delete Hedwig from your devices.

15. Changes

We may change these terms. The current version is always in Hedwig. We announce important changes in the app in good time. If you use Hedwig after that, the new terms apply; if you do not agree, you can delete Hedwig.

16. Governing law and disputes

These terms are governed by Dutch law. Disputes are submitted to the competent court in Amsterdam. If you are a consumer, you keep the protection of the mandatory rules of the country where you live and may also go to the court of your place of residence.
